Abstract:
This study examines the extent to which others – those who are not parties of
a case – are obliged to present documents under their control upon the request
of a party of a case. If the request is accepted, the court would ask the person
having such documents to present them and he would be considered as a
witness rather than a party of the case. Therefore, when a person under such
an obligation rejects to attend to the court he would be subject to the same
procedures applied on witnesses, but if he rejects to presents the documents
this would then be considered as rejecting to implement a judicial ruling,
which is a punishable act.
