Commentary on the court of cassation – Kuwait Verdict No 911 of 2019

Abstract

This research deals with the commenting on the ruling of the court of cassation– the judgment of the Court of Cassation - Appeal decision NO-911-2019. It was issued on 19/11/2019. It ended on cancelling all of the experts management decisions in the period of 20th /10/2014 till 24/12/2017 (abstract cancellation). The court depended on the canceling of those decisions that contradicts with the provisions and provisions of the constitution and international treaties and conventions regarding the principle of justice and the principle of the equality. Also the procedures were similar to those previous and opening procedures on the choosing process. The court has decided to come out with these decisions defaming those decisions as non-existent and the ruling has raised many questions whether the court had the eradication of all decisions or not, and whether actions taken by the management experts are valid or invalid.
