Rights Related to the Prevention and Treatment of the Emerging Coronavirus Disease "Covid 19"

Abstract

This research paper applies the analytical descriptive approach to address a topic of international concern, as the topic is likely to reoccur in the future. This issue deals with the rights concerning the prevention and treatment of the emerging coronavirus disease "Covid-19", and the legal issues concerning human rights, the compatibility and suitability of long-standing procedures applied by countries in the context of our new reality. The paper aims at identifying the challenges of the adequacy of the contents of these rights to this reality. In addition, the paper is examining the conflicting rights and attempt to achieve the needed balance in the light of relevant established rules, as well as judicial decisions. This paper proposes specific recommendations to determine the necessary rights for the prevention and treatment of the emerging disease “Covid-19". This is based on our examination of the procedural controls and conditions restricting rights and freedoms to prevent this disease, and the extent to which material capabilities affect the duties of states in this regard; and the issue of international cooperation in this field, the principle of equality during the Corona pandemic. Add to that, the issue of treatment by consent and by force, and the problem of monopolizing treatments and vaccines for this disease.
